Terms of Service

These Terms of Service ("Terms") govern your use of the SmallBiz Ally website located at apply.bizallypartners.com and any related application forms or services (collectively, the "Service"). By accessing the Service or submitting an application, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. About SmallBiz Ally

SmallBiz Ally is a business funding matching service operated by SmallBiz Ally LLC ("we", "us", or "our"). We are not a lender. We do not originate loans, hold licenses to lend, or make credit decisions. Our role is to collect information you provide and share it with third-party lending partners ("Funding Partners") who may reach out to you with funding options that fit your profile.

2. Eligibility

To use the Service, you must:

  • Be at least 18 years old;
  • Be a legal resident of the United States or an authorized representative of a U.S. business;
  • Represent a business that is legally organized and operating in compliance with applicable law; and
  • Have the authority to bind your business to funding-related agreements.

3. Your Representations

You represent that all information you submit through the Service is true, accurate, complete, and current. Submitting false, misleading, or incomplete information may result in termination of your application and, where applicable, referral to law enforcement or civil action.

4. Consent to Be Contacted

By submitting your application, you consent to be contacted by SmallBiz Ally and its Funding Partners at the phone number and email address you provide, using automated or manual means, including SMS, phone calls, and email, regarding your application and available funding options. Standard message and data rates may apply. Consent is not a condition of any purchase. You may opt out at any time by replying STOP to any SMS message or by emailing [email protected].

5. Information Collection and Use

We collect the information you submit through our application form and information about how you interact with our Service. We use this information to match you with Funding Partners, to communicate with you about your application, to comply with legal obligations, and to improve our Service. 6. Funding Partner Network and Compensation

We may receive compensation from Funding Partners when applications we refer result in a funded transaction. This compensation may influence which Funding Partners we present and the order in which they appear. You are under no obligation to accept any offer presented by a Funding Partner, and you are encouraged to independently evaluate any offer's terms, rates, and conditions before accepting.

7. No Guarantee of Funding

Submitting an application through SmallBiz Ally does not guarantee that you will be approved for or receive funding. All credit decisions are made independently by Funding Partners based on their own underwriting standards. Rates, terms, and availability vary and are determined solely by the Funding Partner.

8. Limitation of Liability

To the maximum extent permitted by law, SmallBiz Ally, its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost business opportunities, or reputational harm, arising from or related to your use of the Service. Our total aggregate liability to you for any claim arising out of the Service will not exceed one hundred dollars ($100).

9. Governing Law

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-law rules. Any dispute arising out of or related to these Terms or the Service will be brought exclusively in the state or federal courts located in the State of Wyoming, and you consent to personal jurisdiction and venue in those courts.

10. Arbitration and Class Action Waiver

Except for claims for injunctive relief, any dispute arising out of or related to these Terms will be resolved by binding individual arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. Arbitration will take place in the State of Wyoming, or remotely by video, at the arbitrator's discretion.

YOU AGREE THAT YOU MAY BRING CLAIMS AGAINST SMALLBIZ ALLY ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the Effective Date at the top of this page. Your continued use of the Service after any change constitutes acceptance of the updated Terms.
